► Summary of this Overhang: The European Regulation of 13 June 2024 on Artificial Intelligence, known as the AI Act, belongs to the European construction of Compliance Law, and does so in three ways. First, by a conception based on aims: like Compliance Law, it is anchored in the goals pursued, namely that human beings should benefit from the technology and not be crushed by it, which is a Monumental Goal. Hence the gradation of risks, by capacity, by sector, or by the harm built into a particular technology, from which the Regulation draws three levels: prohibitions, supervised constraints, and operation that is not specially regulated. Secondly, by an Ex Ante conception: like Compliance Law, which extends Regulation Law, the AI Act does not wait for damage to occur before acting, a choice American law did not make. Thirdly, by internalisation: the custody of the algorithmic system is placed in the very companies that built it, develop it and profit from it, in the continuity of the GDPR and as in Vigilance Law, the cutting edge of Compliance, companies having to identify risks, assess models, and detect and prevent harmful systemic effects. The litigation arising from it will be Systemic Litigation.
