► Summary of the article (done by the Journal of Regulation & Compliance): The author underlines that the Monumental Goal pursued by Personal Data Law is the protection of the individual. It is duplicated in the GDPR with the concern of convergence of liberal economies, which includes this protection. From this results the "conformity criteria" imposed by the texts and the methods that must be adopted by companies, which are above all methods for managing the risks of infringement of the rights of the persons concerned by the data. However, the author highlights what she considers to be the limits of this approach, since the sanctions policy implemented by the CNIL (French Data Protection Authority) does not seem to follow this conception of personal data Compliance based on a risk-based approach, which is regrettable and paradoxically leads companies to design their system more in terms of the risk of sanctions.
