L'arrêt transmet au Conseil constitutionnel la question de savoir si la procédure organisée devant la Cour de discipline budgétaire et financière est conforme ou non à la Constitution, notamment le principe constitutionnel d'indépendance et d'impartialité des juridictions découlant de l'article 16 de la Déclaration des droits de l'homme, Déclaration qui fait partie du "bloc de constitutionnalité". Il vise également l'article 8 de la Déclaration, auquel est rattaché le principe de légalité des délits et des peines.

The ruling sends the Conseil constitutionnel (French Constitutional Council) the question of whether the proceedings in the Cour de discipline budgétaire et financière (French Court of budgetary and financial discipline) is consistent or inconsistent with the Constitution, including the constitutional principle of independence and impartiality of the courts under Article 16 the Déclaration des droits de l'Homme et du Citoyer (French Bill of rights). This Declaration is part of the "block of constitutionality."
The ruling also refers to Article 8 of the Declaration, which is attached to the principle of legality of criminal offenses and penalties, which is applied to administrative jurisdictions, such as th Cour de disciplinaire budgétaire when its decides administrative sanctions.
